1. Acceptance of Terms

By accessing or using runtimeguard.io or any RuntimeGuard API, dashboard or agent software (collectively, the "Service"), you confirm that:

• You are at least 18 years old and have the legal capacity to enter into this agreement
• If you are acting on behalf of an organisation, you have the authority to bind that organisation to these terms
• You have read and understood these Terms and our Privacy Policy

If you do not agree to these terms, you may not use the Service.

2. The Service

RuntimeGuard is a Linux runtime security monitoring service that uses eBPF-based kernel telemetry to detect ransomware behaviour and other suspicious activity on Linux hosts. The Service includes:

• The RuntimeGuard agent software for Linux
• The backend API for event ingestion and detection
• The RuntimeGuard dashboard for incident management
• Alerting integrations (Slack, webhooks)

We reserve the right to modify, update or discontinue features of the Service at any time. We will provide reasonable notice of material changes where feasible.

3. Early Access & Trial

During the early access period, we offer a free trial for a limited period (currently 14 days) following account verification. The following conditions apply to trial accounts:

• Trial accounts are for evaluation purposes only
• We may impose limits on the number of hosts, events or incidents during the trial
• At the end of the trial period, the account will be suspended until a paid plan is activated
• We reserve the right to modify or terminate the trial programme at any time

During early access, the Service is provided on a best-effort basis. Features, APIs and pricing may change as the product matures. We will communicate significant changes to registered users in advance.

4. Your Account

To use the Service, you must register with a valid email address and maintain accurate account information. You are responsible for:

• Keeping your API key secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring that any person using your account does so in compliance with these terms

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. One account per person or organisation during early access, unless otherwise agreed in writing.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these terms. You must not:

• Deploy the RuntimeGuard agent on systems you do not own or do not have explicit authorisation to monitor
• Use the Service to monitor individuals without a lawful basis or their knowledge where required by law
• Attempt to reverse engineer, decompile or circumvent any part of the Service
• Use the Service to interfere with or disrupt the infrastructure of third parties
• Attempt to gain unauthorised access to our systems, APIs or data
• Resell or sublicense the Service without our written consent
• Use the Service in a manner that violates applicable law, including data protection regulations

We reserve the right to investigate and take action against violations, including suspending or terminating your account.

6. Your Data

Ownership: You retain ownership of all data you submit to the Service, including telemetry events, incident data and configuration.

Licence to us: By submitting data to the Service, you grant Wizzler a limited, non-exclusive licence to process that data solely for the purpose of providing the Service to you.

Your responsibility: You are solely responsible for the lawfulness of the data you submit. This includes ensuring that deploying the agent on specific hosts complies with applicable employment law, data protection law and any contractual obligations you have with third parties.

Data processing: Where Wizzler processes personal data on your behalf (e.g. telemetry that may contain personal data), Wizzler acts as a data processor and you act as a data controller. A Data Processing Agreement is available on request.

7. Intellectual Property

The Service, including all software, algorithms, designs, documentation and branding, is the intellectual property of Wizzler. Nothing in these terms transfers any ownership rights to you.

Subject to your compliance with these terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes during the subscription period.

You may not copy, modify, distribute or create derivative works of any part of the Service without our prior written consent.

8. Payment & Billing

Paid plans are not yet available during early access. When paid plans are introduced:

• Pricing will be communicated clearly before any payment is required
• Subscriptions are billed in advance on a monthly or annual basis
• All fees are exclusive of VAT or other applicable taxes
• Failed payments may result in service suspension after a grace period
• Refunds are handled on a case-by-case basis at our discretion

9. Availability & SLA

During early access, the Service is provided without any uptime guarantee. We will make reasonable efforts to maintain availability and will communicate planned maintenance in advance where possible.

Paid plans will include a Service Level Agreement with defined uptime targets. Details will be published when paid plans are launched.

We are not responsible for service disruptions caused by factors outside our reasonable control, including internet infrastructure failures, third-party provider outages or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or that it will detect every threat or security incident
• We are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of revenue, loss of data, or business interruption
• Our total aggregate liability to you in any twelve-month period shall not exceed the amount paid by you for the Service in that period, or €100 where no payment has been made

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Security disclaimer: RuntimeGuard is a detection tool, not a guarantee of security. We do not warrant that use of the Service will prevent all ransomware attacks, data breaches or security incidents. You remain responsible for your own security posture.

11. Indemnification

You agree to indemnify and hold harmless Wizzler and its officers, employees and contractors from any claims, damages, losses or expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these terms
• Your violation of any applicable law or regulation
• Data you submit to the Service that infringes the rights of a third party
• Your deployment of the agent on systems without proper authorisation

12. Termination

By you: You may stop using the Service at any time. To request account deletion and removal of your data, contact us via the contact form.

By us: We may suspend or terminate your access to the Service immediately and without notice if:

• You materially breach these terms and fail to remedy the breach within 7 days of notice
• You engage in fraudulent, abusive or illegal activity
• Continuing to provide the Service to you creates a legal, security or reputational risk
• We decide to discontinue the Service (with reasonable notice)

Effect of termination: Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days of termination, subject to any legal retention obligations. Provisions that by their nature survive termination (including limitations of liability and governing law) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date and notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated terms.

If you do not agree to the updated terms, you must stop using the Service before they take effect.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.

Before initiating formal proceedings, we encourage you to contact us to resolve any dispute informally. We will make reasonable efforts to resolve disputes within 30 days of your written notice.
